Sales & Refund Policy

Please review these policies carefully as they are the terms of sale that govern your purchases at the Murobond Shop. They set out your rights and obligations with respect to your purchases, including important limitations and exclusions, such as those in Murobond's product warranties. Your placement of an order at the Murobond Shop constitutes your agreement that these policies apply to the order, so be certain you understand them before you place your order.

 

Importantly, the rights described in this policy in respect of returns, refunds and warranties are in addition to the statutory rights to which you may be entitled under the Competition and Consumer Act 2010 and other applicable Australian consumer protection laws and regulations.

1. About these Terms and Conditions

In these terms and conditions "we" and "us" mean Murobond Coatings Pty Limited of 81 Dickson Avenue, Artarmon NSW 2064, and "you" means you the customer. Words spelt with initial capital letters are defined terms which, for your ease of reference, are set out at the end of the terms and conditions. These terms and conditions together with your Order constitute the entire Contract between us and you for the supply of Products. No other terms and conditions will apply. The Contract cannot be varied unless we and you agree to vary it in writing or by email.

2. Australian Sales Only

We only sell and ship Products within Australia. We will not make deliveries outside Australia.

3. Sales to End Users Only

The Murobond Shop sells and ships products to end user customers only. Notwithstanding order confirmation Murobond may cancel any order where it has reasonable grounds to believe the product is not being purchased for end use.

4. Hours of Operation

If you would like product and pricing information, our Murobond Specialists are available to assist you Monday to Friday 8.00am to 5.00pm, on 02 9906 7299. For order status information or other assistance with an order you have already placed with the Murobond Shop, please contact Murobond Sales Support on 02 9906 7299 between the hours of 8.00am and 5.00pm Monday to Friday.

5. Placing Your Order

5.1 You may place an Order by either:

5.1.1 filling in the Order Form on the Murobond Shop Web Site and clicking the "Submit My Order" button
or
5.1.2 telephoning us on 02 9906 7299 between 8.00am and 5.00pm (AEST) Monday to Friday, excluding NSW public holidays.

5.2 You must use the Order Form from the Murobond Shop Web Site. We will not accept Orders placed in any way other than those listed above.

5.3 When you place your Order, we will issue you with a Web Order Number.

6. Supply of Your Products

6.1 Subject to these terms and conditions, we will supply to you the Products indicated on your Order Confirmation.

6.2 When your Order has been shipped, we will send you a shipment notification email.

7. Payment Methods

7.1 Murobond allows you to make purchases on our website using PayPal. Please carefully read our policies with respect to payment methods before you place your order.

7.2 If you wish to pay by cheque, bank cheque or money order you must place your Order by telephone.

8. GST

Murobond Shop purchases will include GST. If you phone in your order, the Murobond Specialist will provide the final dollar total of your order including GST and any applicable shipping charges at the time you place your order. The invoice Murobond emails or posts to you will include GST.

9. Prices

Murobond reserves the right to change prices for products displayed at the Murobond Shop at any time, however, subject to Section 23.1 herein, no changes will be made once the Order is confirmed by Murobond.

10. Delivery of Your Products

10.1 All deliveries 20kg and under are sent via Australia Post, registered post is optional. All deliveries over 20kg are sent via TNT.  During the checkout process you will be able to check the shipping costs for your order. No responsibility will be taken for lost/undelivered items.

10.2 We will not deliver any Products to any address outside Australia.

10.3 Orders are usually shipped within 3-5 days from receipt of payment.

10.4 Please allow 4 weeks for delivery of wallpaper. We will advise upon receipt of your order an expected delivery date.

10.5 Please allow 5 days for delivery of Murobond Cement Paint

10.6 Orders placed on the weekend or on a Public holiday will not begin payment processing until the next business day.

10.7 Business days are Monday through Friday, excluding NSW Public holidays. 

10.8 Unless otherwise agreed by us, we will deliver your Products to the ship to address indicated on your Order Confirmation. If no-one is available to take delivery of your Products, our carrier will leave a card requesting you to telephone and arrange a suitable time and date for delivery.

11. Your right to return the products and refunds

The following policy is offered by Murobond in addition to the statutory rights to which you may be entitled under the Competition and Consumer Act 2010 and other applicable Australian consumer protection laws and regulations.

11.1 Tinted paint will not be accepted for return or exchange. Wallpaper will not be accepted for return unless there is a fault. If you are not satisfied with products other than paint, please notify Murobond on 02 9906 7299 immediately. Upon agreement to accept return of products you should return goods within 14 days. Goods must be returned in original condition. If goods are not in original condition, Murobond reserves the right to refuse a refund or exchange.

11.2 The cost of returned goods will be refunded to the credit card payment was made from. Delivery and handling costs will not be refunded.

12. Proof of Purchase

Murobond will send an Order Confirmation via email to the email address with your order.

13. Other Terms and Conditions

13.1 Murobond is not responsible for typographic errors. In the event of a typographical or technical error causing a mistake in price to be shown, Murobond reserves the right to correct the error and charge you the correct price. Before it does so, Murobond will notify you of the mistake and will offer you the opportunity for a full refund. You will receive a notification of this with or prior to your delivery.

13.2 Murobond reserves the right to change the terms and conditions of sale at the Murobond Shop at any time, however no changes will be made once a consumer has completed a purchase, The current terms and conditions will be located on the Murobond website and should be reviewed by the consumer prior to commencing any purchase.

14. Product Warranty

Murowash & PURE (acrylic)
GUARANTEED BY MUROBOND COATINGS PTY LTD (MUROBOND) DATE OF ISSUE: 1.1.2004
Purchasers of Murowash and Pure (Acrylic) are advised that application of the products must be carried out strictly in accordance with the technical specifications and instructions issued by Murobond. Subject to usage in accordance with the above specifications, Murobond agrees that in the event of any defect in respect to usage and application of the products, Murobond will replace the products free of charge. The within warranty is effective for a period of seven years following the date of sale of the products.The within warranty does not extend to consequential damage whether arising from product fault or faulty application, costs associated with contractors or labour costs. This warranty is also conditional upon prompt notification to Murobond of any claim involving defective products and full co-operation being given to Murobond and its agents and representatives in allowing access to the products as applied for the purposes of examination and analysis.

Murolast Elastomeric Membrane, Murolast Superseal, Murolast Acrylic Undercoat
GUARANTEED BY MUROBOND COATINGS PTY LTD (MUROBOND) DATE OF ISSUE: 1.1.2004
Purchasers of Murolast Elastomeric Membrane, Murolast Superseal and Murolast Acrylic Undercoat are advised that application of the products must be carried out strictly in accordance with the technical specifications and instructions issued by Murobond. Subject to usage in accordance with the above specifications, Murobond agrees that in the event of any defect in respect to usage and application of the products, Murobond will replace the products free of charge. The within warranty is effective for a period of ten years following the date of sale of the products.

The within warranty does not extend to consequential damage whether arising from product fault or faulty application, costs associated with contractors or labour costs. This warranty is also conditional upon prompt notification to Murobond of any claim involving defective products and full co-operation being given to Murobond and its agents and representatives in allowing access to the products as applied for the purposes of examination and analysis.

Murobond Cement–Based paint
GUARANTEED BY MUROBOND COATINGS PTY LTD (MUROBOND) DATE OF ISSUE: 1.1.2004
Purchasers of Murobond Cement-based Paint are advised that application of the products must be carried out strictly in accordance with the technical specifications and instructions issued by Murobond. Subject to usage in accordance with the above specifications, Murobond agrees that in the event of any defect in respect to usage and application of the products, Murobond will replace the products free of charge. The within warranty is effective for a period of five years following the date of sale of the products.

The within warranty does not extend to consequential damage whether arising from product fault or faulty application, costs associated with contractors or labour costs. This warranty is also conditional upon prompt notification to Murobond of any claim involving defective products and full co-operation being given to Murobond and its agents and representatives in allowing access to the products as applied for the purposes of examination and analysis.

Aqua Glaze
GUARANTEED BY MUROBOND COATINGS PTY LTD (MUROBOND) DATE OF ISSUE: 1.1.2004
Purchasers of Aqua Glaze are advised that application of the products must be carried out strictly in accordance with the technical specifications and instructions issued by Murobond. Subject to usage in accordance with the above specifications, Murobond agrees that in the event of any defect in respect to usage and application of the products, Murobond will replace the products free of charge. The within warranty is effective for a period of seven years following the date of sale of the products.The within warranty does not extend to consequential damage whether arising from product fault or faulty application, costs associated with contractors or labour costs. This warranty is also conditional upon prompt notification to Murobond of any claim involving defective products and full co-operation being given to Murobond and its agents and representatives in allowing access to the products as applied for the purposes of examination and analysis.

15. Our Liability

15.1 Nothing in this Contract excludes, restricts or modifies any condition, warranty, right or liability implied into this Contract (including any condition, warranty, right or liability imposed by the Competition and Consumer Act 2010), and this Contract should at all times be read subject to your relevant statutory consumer rights.

15.2 These terms and conditions set out the full extent of our obligations and liabilities in respect of the supply of the Products under this Contract and there are no warranties, conditions or other terms that are binding on us except as expressly stated in the Contract.

15.3 Nothing in the Contract shall limit or exclude our liability for death or personal injury caused by our negligence.

15.4 Subject to the Conditions in this clause 25, we will not be liable under the Contract for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.

15.5 Subject to the Conditions in this clause 25, our maximum aggregate liability under the Contract whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.

16. General

16.1 The Contract will be governed by the law of New South Wales. Both we and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of that state.

16.2 The invalidity or unenforceability of any provision of the Contract shall not adversely affect the validity or enforceability of the remaining provisions.

16.3 Neither our failure or your failure to enforce any term of the Contract constitutes a waiver of such term. Such failure shall in no way affect the right later to enforce such term.

16.4 We will not be liable for any loss or damage suffered or incurred by you arising from our delay in fulfilling or failure to fulfil or otherwise discharge any of our obligations under the Contract, to the extent that such delay or failure is caused by any circumstance beyond our reasonable control. Where such delay exceeds 30 days, or we are not able to discharge our obligation within 30 days, you will have the option to cancel your Order.

16.5 While every effort is made to ensure the description, pictures and specification of the goods are accurate, we cannot accept any responsibility for minor discrepancies.

17. Defined Terms

In these terms and conditions:

"Accessory" means any ancillary Product;

"Murobond Branded Product" means Product that is manufactured by or on behalf of Murobond and carries the Murobond trademark;

"Murobond Shop Web Site" means our web site for customers in Australia located at http://http://www.murobond.mybigcommerce.com;

"Murobond Warranty" means Murobond's standard product warranty, the full terms of which are set out below;

"Condition" means a condition contained in these terms and conditions;

"Contract" means these terms and conditions together with your Order;

"Product" means any Product;

"Invoice" means the invoice issued by us to you showing the price of the Products and which is your proof of purchase;

"Non-Murobond Branded Product" means any product that is not Murobond Branded;

"Order" means an order placed by you in accordance with these terms and conditions;

"Order Confirmation" means the order confirmation issued by us to you indicating acceptance of your Order;

"Order Form" means the electronic order form on the Murobond Shop Web Site;

"Product" means any product listed on the Murobond Shop Web Site which we agree to supply to you on these terms and conditions;

"Web Order Number" means the order number issued by us to you;

"Working Day" means any day other than a Saturday, a Sunday or a public holiday in New South Wales.
